Upnex Terms of Use

These terms are an agreement between you and CONTROLLER_NAME, CONTROLLER_ADDRESS, Turkey ("we"), for using the Upnex app. By creating an account or buying Upnex Pro, you accept them. How we handle personal data is explained in the Privacy Policy.

1. The service

Upnex lets you follow TV shows and get reminders before new episodes air.

• Show information (titles, air dates, episodes, images) comes from TVmaze, a third-party, community-maintained database. We don't control it. Air dates can change or be wrong, and the network or streaming service in your country may release episodes at other times.
• Notifications depend on your phone, its settings (for example battery saving), your internet connection, and the push services of Google and Apple.

We work to make reminders reliable, but we can't guarantee that every notification arrives, or arrives on time. Please don't rely on Upnex for anything critical.

2. Your account

• You must be 16 or older to create an account.
• Keep your password safe. You're responsible for activity on your account. Tell us at SUPPORT_EMAIL if you think someone else has access.
• You can delete your account at any time in the app (Settings → Account details → Delete account).

3. Acceptable use

Don't misuse Upnex. In particular, don't:

• try to access other people's data or our systems without permission;
• disrupt or overload the service, including with automated or bulk requests;
• reverse engineer the app, except as far as the law allows;
• use it for anything unlawful.

We may suspend or close accounts that break these rules. Where reasonable, we'll tell you first.

4. Free plan and Upnex Pro

The free plan includes up to 2 show alerts, with reminders a day before and on air day. Upnex Pro is an auto-renewing subscription that adds unlimited alerts, custom reminder times and repeat reminders. The paywall shows exactly what's included.

Buying and billing

• Pro is sold through Google Play or the App Store and billed to your store account.
• Prices are shown in the app before you buy, in your local currency, including VAT where it applies.
• Plans are monthly or yearly.

Free trial

• If a plan includes a free trial (for example 7 days), you're charged when it ends unless you cancel at least 24 hours before the trial ends.
• One trial per person.

Auto-renewal and cancellation

• The subscription renews automatically for the same period at the then-current price, unless you cancel at least 24 hours before the end of the current period.
• Cancel at any time in your store account's subscription settings.
• After cancelling, Pro stays active until the end of the period you've paid for.
• Deleting the app or your Upnex account does not cancel the subscription.

Price changes: we'll tell you in advance, and the store asks for your consent where the law or its rules require it.

Refunds and your right of withdrawal

• Payments and refunds are handled by Google Play or Apple under their refund policies. Request refunds from them.
• Consumers in Turkey: Pro is a service performed instantly in electronic form. Under Article 15(1)(ğ) of the Distance Contracts Regulation, by confirming the purchase after the information shown on the paywall, you approve that the service starts immediately, and the right of withdrawal doesn't apply. Your other rights under Law No. 6502 on Consumer Protection remain.
• Nothing in these terms limits rights you have under mandatory consumer law.

5. Ownership

The Upnex app, name, logo and design belong to us. We give you a personal, non-transferable, revocable licence to use the app for its intended purpose. Show data belongs to TVmaze and its contributors (licensed under CC BY-SA); posters and images belong to their rights holders.

6. Changes to the service

We improve Upnex over time and may add, change or remove features. If we remove a paid feature or significantly change Pro, we'll tell you in advance. You can cancel, and you'll get any refund the law or the store's rules provide.

7. Liability

• The free plan is provided "as is".
• We aren't liable for missed episodes, schedule errors in third-party data, or notifications that don't arrive for reasons outside our control.
• We aren't liable for indirect or consequential losses.

These limits don't apply to liability that can't be limited by law, such as for intent, gross negligence, or death or personal injury caused by negligence. They also don't reduce your statutory rights as a consumer.

8. Ending the agreement

You can stop at any time by deleting your account (and cancelling any subscription in the store). We may end or suspend the service for you if you seriously or repeatedly break these terms, or if we stop offering Upnex. If we stop offering Upnex, we'll give reasonable notice.

9. Changes to these terms

We may update these terms. If a change is significant, we'll tell you in the app at least 30 days before it takes effect. If you don't agree, you can delete your account before then. Continuing to use Upnex after that means you accept the new terms.

10. Law and disputes

• These terms are governed by the laws of the Republic of Turkey.
• Consumers in Turkey: you can apply to the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) or the Consumer Courts, within the limits set each year.

11. App Store terms

If you downloaded Upnex from Apple's App Store, Apple's Standard Licensed Application End User License Agreement also applies. Apple isn't responsible for the app or its support, and has no warranty obligations beyond refunding the purchase price where applicable. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
